If you are or were a Comcast subscriber in the City of Jacksonville, Florida or in DeKalb County, Georgia between June 24, 1997 and February 13, 2012 (the “Class Period”), and suffered damages as a result of Comcast’s alleged failure to comply with the customer service standards contained in Jacksonville Ordinance 97-674-E, Section 710.107 or contained in 47 C.F.R. § 76.309(c), incorporated into the DeKalb County franchise agreement, during the Class Period, you are a member of the Settlement Class and you may be entitled to benefits under the Settlement. The Settlement also imposes other requirements, which are set forth in the Settlement Agreement.

WHAT THIS LAWSUIT IS ABOUT:

The Settlement resolves a lawsuit over whether Comcast complied with the customer service standards set forth in the franchise agreements between Comcast and the City of Jacksonville, Florida and DeKalb County, Georgia during the Class Period. Comcast denies liability, but has agreed to this proposed settlement because it avoids costs and risks from continuing the lawsuit. This Settlement is made without any admission of liability and prior to any adjudication of the merits of the case. The Settlement entitles subscribers to benefits and releases Comcast from any liability.

THE PROPOSED SETTLEMENT:

If you are a Current Subscriber:

Any current Comcast subscriber who suffered damages as a result of Comcast’s alleged failure to comply with its customer service obligations during the Class Period is entitled to receive: (a) two settlement vouchers each with a total value of Five Dollars ($5.00), redeemable toward pay-per-view (“PPV”) programming; or (b) a single settlement voucher valued at Ten Dollars ($10.00) that can be used toward adding an additional service (television, internet, and/or telephone) to your account.

 

If you are a Former Subscriber:

Any former Comcast subscriber who suffered damages as a result of Comcast’s alleged failure to comply with its customer service obligations during the Class Period is entitled to receive a single settlement voucher for free installation of cable television service. The voucher is available to a Former Subscriber only if he/she does not owe a past due balance to Comcast or any Comcast Affiliated Entity. For Former Subscribers with past due balances, the value of the voucher will first reduce the amount owed, and any amount remaining will be applied towards the installation charge.
